Attorneys Brian Kabateck and Shant Karnikian break down the fallout from the collapsed "Broadview Six" prosecution in Chicago, where lead prosecutor Sheri Mecklenburg retired "under protest" in late September, accusing U.S. Attorney Andrew Boutros of personally directing a felony case over her objection and then scapegoating her when it fell apart. The six protesters, including then-congressional candidate Kat Abughazaleh, were charged with felony conspiracy to impede an officer after a demonstration outside the Broadview ICE facility; a federal grand jury twice refused to indict, and an indictment came only on a third attempt after jurors who disagreed were dismissed and Boutros himself addressed the panel, asking anyone struggling with immigration cases to raise a hand. Brian and Shant explain the misconduct allegations, including prosecutorial vouching, contacting a grand juror outside the grand jury room, dismissing dissenting jurors, and handing the judge heavily redacted transcripts. U.S. District Judge April Perry, a former prosecutor in that very office, called it the worst prosecutorial behavior she had seen, and Boutros dismissed the remaining charges with prejudice in May. Judge Perry is now conducting a fact-finding inquiry and has left open appointing a special prosecutor and contempt proceedings, while Boutros has ordered a review of more than 1,000 other grand jury cases; the Justice Department denies Mecklenburg's account.
