Attorneys Brian Kabateck and Shant Karnikian catch up with Ohio Congressman Max Miller, the Republican nominee in Ohio's 7th District, who refused to answer questions in a sworn custody-case deposition and whose lawyers sent cease-and-desist letters to Cleveland TV stations over a campaign ad that federal law doesn't let those stations pull. Brian and Shant explain that Miller's attorney, Alejandro Brito, demanded the stations drop a 30-second ad from Democrat Brian Poindexter's campaign, featuring Summit County Sheriff Kandy Fatheree reading abuse allegations made by Miller's ex-wife Emily Moreno, the daughter of Sen. Bernie Moreno; WKYC, WEWS, WJW, and WOIO all aired it anyway because FCC rules prohibit stations from censoring candidate ads, and Poindexter tore up the letter on camera. Brian and Shant stress that Miller denies all the allegations, that the ad only recites what court documents allege, and that truth is a complete defense to defamation, with extra leeway for political speech. In the deposition, Miller declined to answer repeated questions about a long-reported allegation that he pushed a girl down a staircase while a student at Shaker Heights High School; his lawyer instructed him not to answer, he did not invoke the Fifth Amendment, and Moreno's lawyer asked, "If the incident never occurred, why are you afraid of answering the question?" Miller also acknowledged using testosterone replacement therapy from an online prescription, saying he stopped two years ago, and Brian and Shant poke at his reported comparison to Defense Secretary Pete Hegseth's push on testosterone testing for service members. Brian and Shant note Miller has pledged $1 million of his own money, won his last race with only about 51 percent, and now faces Poindexter, a third-generation union member and apprenticeship trainer, in a tightening race, with the custody trial set for two days after the midterm election. Brian's bottom line: these remain allegations, but voters in a heavily Republican district will soon show how far party loyalty goes.
