Imagine a husband and wife who have been living separately for many years. Their disputes have escalated to the extent that they have reached court. Eventually, they decide to seek divorce by mutual consent and resolve their disputes. But an important question arises: if both have decided not to live together, must they still wait six months for their divorce? The Supreme Court addressed this important question in Amardeep Singh v. Harveen Kaur (2017). Amardeep Singh and Harveen Kaur were married in Delhi on 16 January 1994. They had two children and had been living separately since 2008. Several civil and criminal proceedings had also arisen between them. Eventually, on 28 April 2017, they reached a settlement and decided to seek divorce by mutual consent. The settlement provided for permanent alimony of ₹2.75 crore for the wife and custody of the children with the husband. Section 13B of the Hindu Marriage Act, 1955, provides for divorce by mutual consent. Under Section 13B(1), the spouses must have lived separately for at least one year and mutually agreed to seek divorce. Section 13B(2) prescribes a six-month period after filing the first petition before the second motion can ordinarily be made.
