The eight members of the OPM girl group BINI, together with their legal counsel Atty. Joji Alonso, formally submitted and filed their complaint against an individual on Monday (August 18) at the office of the city prosecutor at the Hall of Justice of Sta. Rosa, Laguna. According to Alonso, the unnamed respondent committed "unjust vexation" under Article 287 in relation to Section 4 (b) of RA 10175 or the Cybercrime prevention act of 2012. "For the information of everyone, this is not a libel case," said Alonso. "We filed a cybercrime case under section 4 (b) of Republic Act 10175 or better known as the Cybercrime Prevention Act of 2012. And this is conjunction with unjust vexation or Article 287 of the Revised Penal Code." "This complaint emanated from a spliced video of the girls who were testing, rating and tasting Filipino street food," the lawyer added. "The original video in this case was running about 20-25 minutes, and the reduced video was running about two minutes and contained nothing but negative reactions, negative comments, on the food that they tasted. So this completely changed the narrative, of the show 'cause what was left was all negativity." Asked why they filed the case in Sta. Rosa, Laguna, she said: "Because this is where the crime was committed. (The video) was uploaded here." The uploaded spliced video took a toll on the girls' mental and emotional state, according to their legal counsel. "And this resulted in online bashing, and even escalated to threats, insults and personal attacks and name calling of the different girls. And naturally, they suffered extremely from mental and emotional anguish and distress because of what happened," said Alonso. As BINI takes this legal stand, Alonso said this will serve as a reminder for the public to use social media with truth, responsibility and accountability.
