The court held that heirs cannot be held personally liable for repayment of a deceased person's loan on the basis of loan renewal documents prepared after the borrower's death. However, the bank retains the right to recover its dues from property mortgaged against the loan, as the borrower's death does not automatically release the property from the mortgage. A bench comprising Justice Chaudhry Sultan Mahmood and Justice Tanveer Ahmed Sheikh issued the verdict on a private bank's appeal, partly allowing the appeal and modifying the Banking Court's decision. The ruling distinguishes between the personal liability of heirs and the legal status of mortgaged property inherited by them.
