Lil Durk, whose legal name is Durk Banks, is asking a federal judge to suppress evidence obtained from one of his phones. The judge has been asked to decide whether law enforcement lawfully seized and retained the phone, and whether the federal government can use evidence from it at trial. In this video, Attorney Jasmine Mines briefly breaks down Lil Durk’s motion to suppress, the government’s response, the five-week period before investigators obtained another warrant covering the phone, and what could happen depending on how the judge rules. But there is another issue that has received far less attention. If the judge excludes important evidence, federal prosecutors may be able to seek appellate review before trial. If the judge allows the evidence and the ruling goes against the defendant, the defendant ordinarily does not have the same immediate appeal route and may have to wait until after final judgment.
