A federal judge on Monday apologized in court to Cole Allen, the man accused of shooting a Secret Service agent and attempting to assassinate President Trump at this yearâs White House Correspondentsâ Dinner, as questions intensify over how the suspect has been treated in custody. U.S. Magistrate Judge Zia M. Faruqui made the remarks during an emergency hearing prompted by what he previously described as âgrave concernsâ about Allenâs conditions of confinement at the D.C. Jail â including his placement in solitary confinement under suicide watch protocols. Allen had been held in what officials describe as a âsafe cell,â a highly restrictive setting that can involve 24-hour lockdown, constant monitoring and limited communication with the outside world. His defense attorneys argued the measures were unnecessary and interfered with his ability to assist in his own legal defense. By the time of Mondayâs hearing, however, Allen had already been removed from suicide watch, and his attorneys withdrew their request for court intervention, calling it âmootâ and asking the judge to cancel the proceeding. Faruqui proceeded with the hearing anyway, signaling continued concern about how the decision to impose those conditions was made. The government defended the initial move, saying Allen made comments suggesting he did not expect to survive his trip to Washington â prompting jail officials to take precautionary measures. Former U.S. Attorney John P. Fishwick Jr. said such decisions typically fall within the authority of corrections officials. âI donât really think a judge should be apologizing for how a jail is keeping anybody whoâs charged with any criminal case,â Fishwick said. âThatâs how they maintain safety, security and his mental health.â Prosecutors allege Allen carried out a violent attack during the high-profile annual event, firing a Mossberg pump-action shotgun and striking a Secret Service agent with buckshot. U.S. Attorney for the District of Columbia Jeanine Pirro said the evidence clearly ties Allen to the shooting. âIt is definitely his bullet,â Pirro said. âHe had every intention to kill him and anyone who got in his way.â Pirro also described surveillance video that she said shows Allen removing a long coat used to conceal the weapon moments before rushing a security checkpoint. Prosecutors plan to present the case to a grand jury this week, with additional charges and more video evidence expected to follow.
