DHS says Aviles Perez also has a previous California arrest involving an alleged machete assault, drugs and theft. ([DHS][1]) * But the ruling did **not** declare Aviles Perez harmless or dismiss the Salvadoran case. Ohta ruled that the government had held him for roughly five months without the individualized bond hearing required to determine whether continued detention was justified based on dangerousness or flight risk. The order requires such a hearing before ICE can detain him again. ([Fox News][2]) * Meanwhile, the Trump administration has returned to the **Supreme Court** seeking emergency relief in its battle over new USPS mail-ballot requirements. Obama-appointed Judge Indira Talwani issued a preliminary injunction preventing mandatory portions of the Postal Service's new rule from taking effect for the November midterms. The requirements involve ballot-envelope standards, intelligent mail barcodes and voter information supplied through a USPS portal. ([Justia Dockets & Filings][3]) * Solicitor General **John Sauer** argues that time is running out as states begin distributing absentee ballots and that leaving the injunction in place could create confusion. Opponents argue the administration lacks authority to impose the requirements and that implementing them this close to Election Day could disenfranchise lawful voters. Justice Ketanji Brown Jackson has requested responses to the administration's emergency filing. ([Reuters][4]) * Elsewhere, Secretary of State **Marco Rubio** is promoting the administration's broader economic strategy, arguing that rebuilding American manufacturing and reducing dependence on foreign supply chains are central to Trump's agenda. * And Trump used the holiday weekend for some characteristically provocative political messaging, including attacks on Democrats and predictions about the upcoming midterms. **Bottom line:** the administration is simultaneously fighting over **immigration detention, mail-ballot regulations and the scope of presidential authority**, with one of those battles now back before the Supreme Court.
