City of St. Paul, Minnesota | 505 U.S. 377 (1992) One morning in 1990, a teenager living in St. Paul, Minnesota, fashioned a cross from the legs of a chair. He then set the cross ablaze on the lawn of a black family that lived across the street. Though no words were uttered, his message of hate was clear to most observers. The teenager was prosecuted under St. Paul’s Bias-Motivated Crime Ordinance. The ordinance criminalized placing on private or public property a symbol that quote “one knows or has reasonable grounds to know arouses anger, alarm, or resentment in others on the basis of race, color, creed, religion, or gender,” unquote. The text specifically named burning crosses and the Nazi swastika as examples of symbols that would violate the ordinance. At trial, the teenager moved to dismiss, arguing that the ordinance violated the First Amendment. The trial court agreed and granted the motion. On appeal, the Minnesota Supreme Court reversed, reasoning that the statute’s language reached only fighting words, which is a form of constitutionally unprotected speech.
