SB 10 explained, in plain english, news about how it works and how it will be implemented in your city. People have been asking me a lot to do a video on "SB10 Explained". My specialty is really helping homeowners build in their backyards with laws like SB9 and the ADU rules. But I'm happy to do a little explainer for SB 10 too. Honestly, I think the media has blown this one out of proportion, and has caused a lot of confusion by grouping it with SB 9. The bills do very different things. Senate Bill 10 is a local control bill that speeds up the existing zoning process, and gives cities some limited ways to supersede restrictions from ballot initiatives. In the past, if a city wanted to upzone a lot (or increase its density), it could trigger a lot of regulations and lawsuits. CEQA required them to do an EIR (environmental impact report) and people could bring suit against the city to question the EIR and slow down the zoning. Now, if a lot is in a transit rich area or an urban infill, the city can increase the density to allow for up to 10 units without triggering CEQA. Note: if somebody wants to develop a building on that lot after it is upzoned, their project may still trigger CEQA. It is just the city's zoning process that has been exempted. There is a controversial bit to this law which is that a legislative body like the city council can upzone a property and supersede some restrictions put in place by a ballot initiative. It requires a 2/3 majority vote and there are already people questioning whether this part will really be used and how it will be enforced. In any case, I walk through all this information and provide some examples in the video. Also, can we please try to keep partisan politics out of the comment section.
