Proposed US Superintelligence Ban Raises Alarm Among AI Executives in India & The World A proposed American law seeking to prohibit artificial superintelligence has attracted attention in India & The World because it could expose technology executives to severe criminal penalties and influence future AI regulation worldwide. US Senator Bernie Sanders and Representative Greg Casar announced the Ban Artificial Superintelligence Act in September. The proposal would permanently prohibit the development and deployment of AI systems capable of surpassing human intelligence, resisting shutdown instructions or threatening government control. It would also temporarily pause the development of certain advanced AI systems until a new federal regulator creates safety standards, model-review procedures and enforcement mechanisms. Individuals who deliberately violate or circumvent the proposed restrictions could face up to 20 years in prison—a punishment compared by the lawmakers to existing penalties for unlawfully developing nuclear weapons. Companies could face a “corporate death penalty,” potentially involving dissolution or loss of their legal right to operate. The proposal has generated headlines involving executives such as OpenAI’s Sam Altman and Anthropic’s Dario Amodei. However, the legislation does not automatically send any AI chief executive to jail. Criminal punishment would apply only if the bill became law and prosecutors proved that an individual knowingly violated its prohibitions. For Indian AI companies and multinational executives operating in the United States, the debate is significant. Even before passage, it signals that governments may increasingly hold senior management personally responsible for unsafe AI development rather than limiting consequences to financial penalties against companies. India currently has no equivalent law permanently banning superintelligence or imposing this specific 20-year sentence. Nevertheless, Indian founders may need stronger safety testing, board oversight, documentation and legal compliance as AI regulation becomes increasingly international.
