SBI Faces ₹5,000-a-Day Liability After Losing Borrower’s Property Papers The Bombay High Court has directed the State Bank of India to compensate a Mumbai-based firm at ₹5,000 per day after the bank admitted that it could not locate original property documents deposited as loan security. In Vogue Creations had submitted title papers for two industrial units in Prabhadevi and documents concerning an MIDC property in Taloja when obtaining credit facilities in 1979. The firm repaid its borrowing in August 2003, but the documents were not returned. SBI issued a no-dues certificate in July 2023 and subsequently acknowledged that the papers were untraceable. On September 2, 2026, a division bench comprising Acting Chief Justice Ravindra Ghuge and Justice Gautam Ankhad ordered SBI to pay ₹5,000 for every day from December 1, 2023 until it supplies certified copies and completes a legally usable reconstruction of the title records. The bank was given 12 weeks to finish the process and must bear the associated costs. The accumulating amount is compensation for continuing delay—not a one-time fine for accidentally losing papers. At ₹5,000 daily, the liability increases by approximately ₹18.25 lakh annually. It had already crossed ₹50 lakh by September 2026, before adjusting the ₹1 lakh previously deposited following Banking Ombudsman proceedings. If compliance were delayed for many years, the total could theoretically approach the value of a modest property.
