A Gurugram restaurant has been ordered to refund a ₹116.30 service charge and pay an additional ₹31,000 after a consumer challenged its billing practice. The district consumer commission found that the establishment had committed deficiency in service and adopted an unfair trade practice by imposing the charge. The dispute arose after a family dinner when the customer received a bill carrying a 10% service charge on ₹1,163. According to the complaint, he asked the restaurant to remove the additional amount, but it refused. He subsequently approached the consumer commission seeking a refund and compensation. Under the Central Consumer Protection Authority’s guidelines, restaurants cannot automatically add service charges to bills, collect them under another name or force customers to pay. Payment must remain voluntary, and customers cannot be denied entry or service for refusing it. The Delhi High Court upheld these guidelines in March 2025. Nevertheless, enforcement action against restaurants shows that automatic billing continues. Service charges are distinct from applicable government taxes, and diners remain free to leave a voluntary tip. Customers facing such demands can request a corrected bill and retain the invoice and payment evidence. Unresolved complaints can be registered through the National Consumer Helpline at 1915 or its official portal. Compensation depends on each case; this award does not create an automatic payout for every disputed bill.
