Hague Arbitration Panel Rules India Must Continue Following Indus Waters Treaty An arbitration tribunal in The Hague has ruled that India cannot unilaterally suspend the Indus Waters Treaty and must continue observing its obligations towards Pakistan. The decision has been widely described as an international court judgment against India. The ruling was issued by a Court of Arbitration constituted under the treaty, with proceedings administered by the Permanent Court of Arbitration. The tribunal said the 1960 agreement remained legally in force despite India placing it in abeyance in April 2025 following the Pahalgam terrorist attack that killed 26 people. The interim order particularly concerns India’s Ratle hydroelectric project on the Chenab River in Jammu and Kashmir. It restricts India from raising the project’s dam wall and power-intake structure beyond specified levels until a separate neutral expert decides whether its design complies with the treaty. That assessment is expected by July 2027, with the restrictions continuing for 90 days afterward. Pakistan welcomed the ruling, arguing that it protects the country’s water rights. The Indus treaty allocates the eastern rivers largely to India and the western rivers—Indus, Jhelum and Chenab—primarily to Pakistan, while permitting India limited uses, including hydroelectric generation. India categorically rejected the order. The External Affairs Ministry described the tribunal as an “illegally constituted so-called Court of Arbitration” and maintained that it had no jurisdiction over India’s sovereign decisions. New Delhi said the ruling would not affect its actions concerning ongoing projects. The judgment therefore strengthens Pakistan’s legal position, but enforcement remains uncertain because India rejects the tribunal’s legitimacy.
