Why a Person Who Failed School Can Still Become a Chief Minister in India India’s Constitution does not require a chief minister, minister or election candidate to hold a school certificate or university degree. Therefore, a person who failed examinations—or received little formal education—can legally become a chief minister if the other constitutional requirements are satisfied. A chief minister is appointed by the governor and must command the confidence of the state Legislative Assembly. Normally, the person is a member of the Legislative Assembly or Legislative Council. Under Article 164(4), someone who is not a state legislator may also be appointed, but must enter either House of the state legislature within six months or leave office. To contest an Assembly election, a candidate must be an Indian citizen, be registered as an elector, take the prescribed oath and be at least 25 years old. The minimum age for a Legislative Council seat is 30. Laws also prescribe disqualifications involving matters such as certain criminal convictions, insolvency, foreign citizenship and specified offices of profit. Academic qualifications are not included. This reflects India’s democratic principle that political leadership should be decided by voters and legislative support, rather than by an educational certificate. Formal education was also inaccessible to much of the population when the Constitution came into force. India’s literacy rate was only around 18.3% in the 1951 Census. Requiring degrees would therefore have excluded most citizens, particularly poorer people, women and historically disadvantaged communities, from political participation. Candidates must disclose their educational background in election affidavits, allowing voters to consider it before voting. However, education disclosed in an affidavit is information—not an eligibility test. Supporters of minimum qualifications argue that administrators should possess basic knowledge. Critics respond that degrees do not guarantee integrity, intelligence or leadership. Under the present system, electoral choice and legislative confidence remain the principal tests.
